2. Scope
These Terms and Conditions apply to all orders placed on the MAISON LEROY LLUKES website.
By placing an order, the customer acknowledges having read these terms.
Any mandatory provisions from which the consumer may benefit under the legislation applicable in their country of residence remain unaffected.
3. Products
MAISON LEROY LLUKES develops collections produced in limited quantities.
The essential characteristics of each item are presented directly on its product page, including:
- description;
- fabric;
- manufacture;
- care;
- available sizes;
- price.
Product photographs and representations are prepared with the greatest possible care.
However, slight differences in colour or appearance may occur depending on the screen used or the characteristics of the materials.
MAISON LEROY LLUKES reserves the right to modify, suspend or withdraw a product from sale at any time.
4. Availability
All products are offered subject to available stock.
Size availability is shown directly on the product pages.
A sold-out size may remain visible on the website but can no longer be ordered.
In the exceptional event that an item becomes unavailable after an order has been confirmed, the customer will be informed as soon as possible.
The corresponding amount will then be refunded if the customer does not accept an alternative solution.
5. Prices
The applicable prices are those displayed on the website when the order is placed.
The currency used is clearly indicated to the customer before the order is confirmed.
All prices are expressed in Swiss francs (CHF).
Delivery charges are shown separately before final confirmation of the order. MAISON LEROY LLUKES reserves the right to change its prices at any time. A price change does not affect an order that has already been confirmed.
6. Delivery charges
Applicable delivery charges are shown to the customer before final confirmation of the order.
Delivery is complimentary for orders sent within Switzerland.
For orders sent to the European Union and the United Kingdom, applicable delivery charges are shown at checkout.
Delivery terms are detailed in our Delivery policy.
7. Taxes, customs duties and import charges
Orders dispatched outside Switzerland may be subject to customs duties, import VAT and any customs clearance or administrative charges depending on the destination country.
These charges are not included in the price of the products or in the delivery charges billed by MAISON LEROY LLUKES when the order is placed.
International orders are dispatched under DAP (Delivered At Place) terms. Any customs duties, import taxes and customs clearance charges are therefore payable by the recipient and may be requested by the carrier or the relevant authorities before or at the time of delivery.
The amount of these charges depends in particular on the destination country, the value of the order, the nature of the goods and the applicable regulations. MAISON LEROY LLUKES does not determine these amounts.
The customer is responsible for paying any import charges required for delivery of their order.
8. Placing an order
Before confirming an order, the customer must be able to check, in particular:
- the selected items;
- sizes;
- quantities;
- the price;
- the delivery address;
- delivery charges;
- the total order amount.
The customer must be able to correct any errors before final confirmation.
Confirming the order creates an obligation to pay.
An order confirmation is sent to the email address provided by the customer.
This confirmation contains the main information about the order.
Swiss online shops must, in particular, allow errors to be corrected before an order is placed and confirm the order electronically without delay.
9. Refusing or cancelling an order
MAISON LEROY LLUKES may exceptionally refuse or cancel an order, particularly in the event of:
- declined or incomplete payment;
- reasonable suspicion of fraud;
- clearly incorrect information;
- exceptional unavailability of an item;
- misuse of the website;
- a clearly abnormal order;
- an attempt at unauthorised commercial resale in large quantities.
When a paid order is cancelled by MAISON LEROY LLUKES, the relevant amount is refunded to the customer.
10. Payment
Payment is made through the secure solutions offered at Shopify checkout.
The payment methods actually available are displayed directly to the customer before the order is confirmed.
These may include payment cards and certain digital payment methods compatible with Shopify.
MAISON LEROY LLUKES does not directly retain the customer’s full banking details.
An order for which payment is declined or cannot be completed cannot be processed.
11. Delivery
MAISON LEROY LLUKES currently delivers:
- within Switzerland;
- to the European Union countries we serve;
- to the United Kingdom.
The main carrier used is DPD.
Orders are generally prepared within 1 to 3 working days after payment confirmation.
During certain busy periods, particularly collection launches, this preparation time may be slightly extended.
Transport times vary according to the destination and any customs formalities.
Once the order has been dispatched, the available tracking information is sent to the customer.
Detailed arrangements can be found in our Delivery policy.
12. Delivery address
The customer is responsible for the accuracy of the information provided when placing an order.
In particular, the customer should check:
- their name;
- their address;
- their postcode;
- their town or city;
- their country;
- any additional information needed for delivery.
If an order cannot be delivered because the customer has provided incorrect or incomplete information, reasonable costs associated with redispatch may be charged to the customer where permitted by applicable law.
13. Returns and the right of withdrawal
A return or exchange may be requested within 14 days of receiving the order.
The precise arrangements are detailed in our Returns & exchanges policy.
For a standard return, the cost of returning the item to MAISON LEROY LLUKES is payable by the customer.
For consumers who have a statutory right of withdrawal, particularly in the European Union and the United Kingdom, this right may be exercised without having to give a reason for the return. The direct cost of returning the goods may remain payable by the consumer where they have been informed of this in advance.
The consumer’s mandatory statutory rights remain unaffected in all cases.
14. Size exchanges
Exchanges are only possible for another size of the same item, subject to availability.
For an exchange:
the customer pays the cost of returning the item to MAISON LEROY LLUKES.
Once the item has been received and accepted following inspection:
MAISON LEROY LLUKES pays for dispatching the new size to the customer.
For international orders, the new size is dispatched under the same customs terms as the original order. Any customs duties, import taxes or customs clearance charges may therefore remain payable by the recipient.
If the requested size is no longer available, a refund may be offered.
The full conditions are available in our Returns & exchanges policy.
15. Refunds
Once the return has been received, the item is inspected.
When the return is accepted, the refund is issued to the payment method originally used.
MAISON LEROY LLUKES may wait until the returned product or proof of its dispatch has been received before issuing the refund, where permitted by law. Where applicable legislation requires the original standard delivery charges to be refunded, these will also be refunded.
Additional costs resulting from the customer’s voluntary choice of a delivery method more expensive than the standard method are not necessarily refunded.
For EU sales, the trader must, in particular, refund the cost of the original standard delivery when a consumer validly exercises their right of withdrawal.
Any customs duties, import taxes and customs clearance charges paid directly by the customer to the carrier or the relevant authorities are not refunded by MAISON LEROY LLUKES. Where possible, the customer must take the necessary steps directly with the organisation concerned.
16. Faulty item or order error
If the customer receives:
- an item with a fault;
- an item different from the one ordered;
- a size different from the one ordered;
they must contact our customer service team so that the situation can be assessed.
Photographs may be requested where they help to verify the problem.
Where the error or fault is confirmed, MAISON LEROY LLUKES covers the costs necessary to return and replace the product.
If a replacement is not possible, a refund will be issued to the payment method originally used.
17. Statutory guarantees
Products sold by MAISON LEROY LLUKES benefit from the mandatory statutory guarantees applicable to the customer.
These Terms and Conditions do not limit a consumer’s statutory rights in the event of a faulty or non-conforming product.
18. Product damaged during transport
If a parcel or product arrives damaged, the customer must contact MAISON LEROY LLUKES as soon as possible.
The customer may be asked to keep:
- the product;
- the packaging;
- the delivery box;
- photographs of the damage.
Where transport damage is confirmed, MAISON LEROY LLUKES will cover the appropriate solution and may open a claim with DPD.
19. Intellectual property
The trade marks, logos, photographs, videos, texts, creations, drawings, graphics, designs and other content on the website are protected by applicable intellectual property rights.
They belong to MAISON LEROY LLUKES / Noa Toma LLUKES or are used with the permission of their respective rights holders.
Any unauthorised reproduction, distribution, modification or exploitation is prohibited, unless otherwise provided by law.
20. Use of the website
The website must be used lawfully and normally.
Any attempt, in particular, to:
- disrupt its operation;
- circumvent stock limits;
- access certain information without authorisation;
- abusively automate orders;
- carry out fraudulent transactions;
may result in the relevant use being blocked and, where justified, an order being cancelled.
21. Liability
MAISON LEROY LLUKES takes reasonable care in operating the website and ensuring the accuracy of the information it contains.
However, temporary interruptions or errors may occur for technical or maintenance reasons or for reasons beyond our control. To the extent permitted by law, MAISON LEROY LLUKES cannot be held liable for indirect damage resulting from use of the website.
No provision of these Terms and Conditions excludes liability that cannot legally be excluded.
22. Events beyond our control
MAISON LEROY LLUKES cannot be held liable for a delay or temporary inability to fulfil an obligation where this results from an event reasonably beyond its control.
This may include significant disruptions to:
- transport;
- customs;
- essential services;
- IT systems;
- or exceptional natural or administrative events.
The consumer’s mandatory rights remain unaffected.
23. Personal data
The processing of personal data collected when using the website or placing an order is described in our Privacy policy.
Information about cookies and similar technologies is provided in our Cookie policy.
24. Applicable law
These Terms and Conditions are governed by Swiss law.
However, this choice of law does not deprive a consumer of the mandatory protections from which they may benefit under the legislation applicable in their country of residence.
Mandatory rules on the territorial jurisdiction of courts also remain unaffected.
25. Changes to these terms
MAISON LEROY LLUKES may amend these Terms and Conditions.
The version applicable to an order is the one available when the order is placed.
